AREAS

Bankruptcy
and Bankruptcy Litigation.
Bankruptcy litigation is very different than other
types of litigation. Primus Law Office, P.A. has
been involved in bankruptcy litigation throughout
the country. This includes successfully defending
claims brought by bankrupt motor carriers whose
Bankruptcy Estate has made claims against its
former customers for alleged underpayment of freight
charges, past due penalties, and related issues.
Bankruptcy litigation also includes preference
claims brought by a bankruptcy estate against
its former vendors or suppliers. In addition to
matters where our office has acted as local counsel,
Primus Law Office, P.A. also acts as local counsel
for firms outside of Minnesota whose clients are
involved in litigation in bankruptcy courts in

& Business Planning. Legal planning
for corporations and businesses is intended to
avoid problems before they arise. Planning services
available include the startup of a new business
entity and deciding whether the business is best
conducted as a corporation, a partnership or a
variation such as a limited liability corporation

Family
Law. Primus Law Office has represented
three generations of clients in family law matters.
These include divorce (marriage dissolution),
child custody, visitation, support, adoption,
post decree actions, paternity and other areas,
including more unusual actions such as grandparent
custody and visitation actions. We have appeared
in many counties in the state, and have represented
clients residing in other states and countries

divorce cases can be very emotionally and financially
draining, and work hard to resolve these matters
with sensitivity to both concerns. We have worked
within the Alternate Dispute Resolution framework
for years, and have employed many of the resources

Publishing
& Copyright Law. Over the years we have represented
both businesses and individuals in many aspects
of publishing and copyright law. Obtaining a copyright
is simply the first step in protecting your rights
in your work. Publishers of works must make certain
that they obtain the right type of license to
use the work for the purpose they intend, under
acceptable terms.
Authors, artists and performers
must make certain that they understand what their
rights are and what rights they are being asked
to grant. There are limited licenses that could
allow the author to retain full use of his or
her work for any purpose whatsoever while still
allowing the publisher to use it for the purpose
for which they contracted. There are also exclusive
licenses that would prevent use of the work by
anyone other than the publisher.
Non-competition agreements are common
in publishing agreements, requiring both parties
to be careful as to the manner in which they may
be restricting their future business. There are
a myriad of different agreements that can be made.
The wording of licensing agreements, publishing
contracts and contracts for representation is

Sexual
Abuse Litigation. Sexual abuse litigation
is not identical to sexual harassment litigation,
although their can be some overlap. Sexual abuse
litigation generally involves a person who is
vulnerable, for instance, a person who is seeking
the help of a counsellor or therapist as the result
of emotional distress or suffering, being subjected
to sexual abuse by the person they went to for
help.
Primus Law Office, P.A. has represented
individuals in sexual abuse claims against various
institutions and individuals since bringing the
first action under the University of Minnesota
Sexual Harassment Procedure. We have handled matters
against priests, ministers, psychologists and
psychiatrists. We have been able to use our experience
in these suits to advise employers and professional
groups as to procedures to avoid these claims
and appropriate responses when claims are made
against their organization or business. It is
a particularly difficult area for employers. They
need to respond appropriately as soon as a claim
is made, or they could end up increasing their
liability for a situation of which they may not

Transportation
& International Trade. (MORE).
Workers
Compensation. The area of Workers Compensation
involves injuries arising out of and in the course
of employment. The Workers Compensation law is
one of the more complex systems in the state.
It was drafted with the concept that attorneys
would not have to be involved in the system, and
that is often true. However, once the system breaks
down, it is very difficult for a lay person to
figure out what happens next.
Primus Law Office, P.A. has represented
employees in Workers Compensation actions for
many years. Laurel Learmonth was a co-presenter
with an attorney who normally represents employers
and insurers to present a day long seminar on
some of the most complex areas of the Workers
Compensation Law.
Although employers in Workers Compensation
actions are normally represented by attorneys
chosen by the employers Workers Compensation insurance
carrier, Primus Law Office, P.A. has represented
employers in relation to a number of issues surrounding
workers compensation and workers compensation
coverage, including how workers compensation ties
in with the employer's obligations under the Americans
with Disabilities Act, when a business is required
to obtain workers compensation coverage, and the
rights of an employer, as separate from the insurer,
in a specific workers' compensation claim.
